Inferno Bros ENT holds reservations for 10 days to allow mailing time of deposit. The remaining balance is due and payable 2 weeks prior to the event unless scheduled otherwise. Inferno Bros ENT will not set up any equipment until full payment is received. Payments made after due date are subject to a $25.00 late fee. Client shall fill out and keep a contract copy for their records. Client shall then sign and return an additional contract copy with the deposit to Inferno Bros ENT. Make all checks and money orders payable to Brandon Westmoreland 4886 Williams Rd Hernando, MS 38632. Client agrees to provide a grounded standard 3 prong, 110 volt electrical outlet within 40 feet of the provided set up location. Client also agrees to provide one table with table clothe. By signing, the parties acknowledge and confirm that they have read, and agree to the terms, conditions and all sections set forth in this agreement. Additional payment terms: There will be a $25.00 fee charged for all returned checks. Clients are welcome to add gratuity for the entertainer depending on service provided. Cancellation: This agreement cannot be canceled or modified except by the client or Inferno Bros Ent and only then, if terms are mutually agreed upon. In the event of a cancellation, the client agrees to give a 45 day written notice and pay 75% of the contract price. If a 45 day written notice is not given the client agrees to pay the remaining balance of the entire contract price. Rescheduled events are subject to availability. In the unlikely event that the designated entertainer is unable to perform at the event and a replacement cannot be found, Inferno Bros Ent will make a full refund of any deposits or payments made by the client. The client agrees that the refund will be the full extent of damages that they are entitled to and no further damages may be sought against Inferno Bros Ent. If litigation for any item in this contract is necessary for collection Inferno Bros Ent shall be entitled to all reasonable attorney fees, court costs and collection expenses. The invalidity of any provision of this agreement shall not affect the validity of any other provision. Overtime Costs: Whenever possible, requests for extended playing time during an event will be accommodated. However, availability of the designated entertainer(s) beyond contract time cannot be guaranteed by Inferno Bros Ent. Overtime may be requested in increments of one hour at a rate of $75.00 per hour unless otherwise agreed upon. Payments for overtime is due on date of event and shall be made with cash only. Additional Provisions: The client shall ensure that the performance facility is open and available at least 2 hours prior to scheduled “start time”, and that the performance facility meets all federal and state safety regulations. For outdoor performances, the client shall ensure adequate shelter is provided to protect Inferno Bros Ent equipment from adverse weather conditions. Neither party shall be responsible for personal injury or property damage or loss except to indemnify and hold each other harmless from any claims, loss, costs or damages incurred arising from personal injury or property damage caused by the acts or omissions of the responsible party’s students, employees, agents, contractors or subcontractors. Inferno Bros Ent personnel reserve the right to deny any guest access to supplies or equipment. In the unlikely event Inferno Bros Ent’s performance is delayed, liability is limited to providing client performance time equal to time lacking.
